Does NJ Allow Temporary or Occupational Driving Privileges During the DUI License Suspension Period?

Clients often inquire about the possibility of obtaining a temporary license during the DUI license suspension period that would allow them to drive to work or complete other necessary functions. In short, New Jersey, unlike some other states, does not allow this type of temporary license. While the Chief Administrator of the Motor Vehicle Commission does implicitly have the authority to grant such a license, the DMV has adopted a strict policy of not granting temporary or occupational licenses in DUI and refusal cases. Thus, absent any law providing otherwise, the current policy in New Jersey is that there are no occupational or temporary licenses permitted for defendants convicted of DUI or refusal.
