Do I Have to Appear in Person in New Jersey Traffic Court?

Quite often, people who don’t live in New Jersey become involved in New Jersey Traffic Court matters. This can happen when an out-of-state resident receives a ticket while driving in New Jersey, or when a New Jersey resident gets a ticket and then later moves out-of-state. Failing to resolve the ticket is typically not an option as that can compromise your driving privileges. But what can an out-of-state resident do to avoid traveling to New Jersey to resolve their ticket?

Under the New Jersey Rules of Court, municipal courts may accept a duly executed affidavit or certification from an out-of-state resident in lieu of their live testimony in court. This is called a “plea by mail.” Under this rule, a New Jersey lawyer may bring the out-of-state client’s sworn testimony to court in the form of an affidavit or certification and the client can avoid traveling to New Jersey to appear in court. There are certain qualifications the client must meet, in addition to requirements relating to the form and substance of the sworn testimony, and the court need not accept improperly submitted testimony under the rule.
